AGREEMENT:

INTELLECTUAL PROPERTY:

The appropriate and legal use of all intellectual property of ExpertShirt, and others is required under this Agreement. Unless otherwise indicated on the WebSite, all images, designs, icons, logos, photographs and other materials that appear on this WebSite are copyrights, trademarks and trade dress and/or other intellectual properties owned, controlled and/or licensed by ExpertShirt.

You agree to not use this WebSite or service to create any material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar obscene, libelous, invasive of anothers privacy, hateful, or racially, ethically or otherwise objectionable. You agree not to use this WebSite or service to create any material that infringes on any patent, trademark trade secret, copyright or other rights of any third party.

The products created using images from this WebSite are not the exclusive property of the customer. As such the products should not be resold commercially without the written approval of ExpertShirt. ExpertShirt specifically retains the right to display all designs created on the WebSite and to resale the same to other customers.

We have the sole right to reject any order that we consider unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of privacy, hateful, or racially, ethically or otherwise deemed objectionable in our sole discretion.

INDEMNITY:

You understand and agree that you will defend, indemnify and hold ExpertShirt, its associated entities, and representatives harmless from and against all claims, damages, costs, expenses, including reasonable attorney fees, relating in any way to your use of this WebSite and/or the sales or services of ExpertShirt; your failure to comply with this agreement; and/or your violation of the rights of any third party.

GOVERNING LAW AND JURISDICTION:

The laws of the Commonwealth of Kentucky, and where applicable, federal law, shall apply to all disputes related to your use of this Website, including, but not limited to, all issues related to sales, services, products, delivery, payment, and indemnity.

You agree that the sole and exclusive jurisdiction for the purpose of resolving any dispute shall be the United States District Court, Western District of Kentucky, Louisville Division.

ExpertShirt does not provide any warranty of any kind, implied, express, or statutory, including, but not limited to, the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose or freedom from computer virus.
